Injured workers often fail to receive the benefits they are entitled to and the full protection of the law without effective legal representation.  Too often, employers fail to file a written report of the employee’s injury in a timely fashion, thus delaying, and effectively preventing the injured worker from receiving the benefits he or she is entitled to.  Hence, the need arises for a Notice of Claim to be filed which effectively forces the employer and his insurance company to take notice.  Also, Workers’ Compensation has many steps, levels, and procedures that need to be followed so that a worker can be protected.  Different forms of benefits are payable and effective counsel is often necessary to make sure that the proper benefits are paid at the proper time. 

If an injured worker is able to perform light work, but his employer does not have that type of work available, an injured worker needs to look for light work elsewhere.  Failure to make job searches under those circumstances would deprive the injured worker of the benefits he or she otherwise would be entitled to obtain if the worker had been informed of the need to search for appropriate light work.  An attorney can advise and assist the worker to make the appropriate job searches.
